Residential Regulations

Affordable Housing Program Regulations

To lessen the shortage of housing, affordable to moderate, median, low, and very low-income households in the City of Emeryville, the city created the Affordable Housing Program (AHP).

Multi-Unit Residential Development Guidelines

The City established a set of Multi-Unit Residential regulations promote family-friendly, affordable housing by establishing minimum standards for unit mix and design.

Unbundled Parking Regulations

The City requires parking spaces of new multi-unit residential uses of 10 or more units to be leased or sold separately from the rental or purchase fees for dwelling units so that potential renters or buyers have an option of renting or buying a residential unit at a lower price than would be the case if there were a single price for both the residential unit and the parking spaces. The Community Development Director may grant an exception from the Unbundled Parking Requirements for affordable units which include financing for affordable housing that requires that costs for parking and housing be bundled together.

Smoke Free Multi-Unit Housing Regulations

The City of Emeryville adopted a Smoke Fee Policy in 2019.  Smoking is prohibited in all areas, including common areas, and all units of a multi-unit residence, including any associated exclusive-use enclosed areas or unenclosed areas, such as, for example, a private balcony, porch, deck, or patio.

Accessory Dwelling Unit Regulations

The City adopted a series of regulations to encourage the establishment of accessory dwelling units (ADUs) and junior accessory dwelling units (JADUs). These dwelling units provide a valuable housing resource and help to achieve the goals, objectives, and policies of the Housing Element of the General Plan to promote a range of affordability levels.

Live/Work Regulations

The City adopted Live/Work Regulations to provide space that allows for a flexible combination of residential and nonresidential uses to meet the changing needs of the Emeryville community. The intent is to encourage small, independent, and creative businesses and artistic endeavors throughout the City.

Preservation of Significant Structures and Residential Units

The city adopted the Preservation of Significant Structures and Residential Units to encourage the preservation and reuse of such structures. Significant structures reflect the City’s heritage, contribute positively to the City’s aesthetic character, and provide opportunities for reinvestment. The City’s existing housing stock is an important community resource which the City desires to preserve.
